chambers in protest over the latest policing plan. john sasaki is there live. >> reporter: they are facing vocal opposition from critic of a plan to bring in william bratton. they think spending $250,000 to hire former los angeles police chief and new york police commissioner william bratton is a waste of money. bratton is attractive to city officials because of the expertise. some of his past policies are considered overzealous. even unconstitutional including stop and terrific. after a deadly 2012 with 126 homicides though, city officials say something needs to be done. >> there's no proof that gang conjunctions work. there's no proof that youth curfews work. >> it's about management. jordan needs to go. william bratton needs to go. and we need to go up and line the doors of opd. >> let me say this. he is one of the most profound experts in policing in america. we're fortunate to have a relationship with him. i support him being here. >> we're all over the place. i think we need to be able to craft a strategy for oakland and how we're going to provide safety for our neighborhoods.

man of the man gunned down in a hail of gunfire at the bay fair b.a.r.t. station. john sasaki spoke with the victim's family who says this murder victim was full of peace and love. >> reporter: this east bay family has a big hole in their lives. 50-year-old kevin seats was shot and killed in san leandro on saturday afternoon. >> he just had a big heart. very generous. he was dependable, you could always count on him for anything. >> reporter: seats and tammy scotts were domestic partners and he was father to tammy's son who called him dad. it appears that he was just caught in the cross fire between two groups of people who started shooting at each other. >> loved everybody he came across. just you know just a good individual that died way too young. and it ain't really -- it's not right. >> reporter: seats was from georgia, served in the army, was a big atlanta falcons fan and worked numerous jobs including driving a delivery truck across the state. >> just a positive role model for the youth. i think that if it was more kens out here to help with the violence or the street violenc

health and science editor john fowler is live in san jose where officials warn that this potentially deadly flu season is only getting started. john? >> reporter: that's right. tonight i have been seeing more and more people coughing and keeping their distance. officials say one death, there could be many more. >> typical peak of flu a month away the first flu death. >> a 98-year-old woman that had chronic illnesses. >> reporter: he said she died a week ago. althoughthe state does not report deaths in those over 65. we found a myth keeping some from getting the flu shot. >> i am scared. it gets me sick. >> reporter: but they are swamped with demand and out of flu vaccine. i checked this walgreen's. they had 100 doses right now but would ship what is left tomorrow to other stores that have run out. it is procrastinators and people seeing a bad flu season back east. >> this is not the typical time but that is what we are seeing. >> reporter: the county will offer two flu shot clinics here in san jose. some doctors and the medical center also have vaccine. this death highlights what is
